NIH Just-In-Time Requirements

The National Institutes of Health recently released Notice NOT-OD-10-120 which revises and clarifies the responsibilities of applicants in regards to the submission of Just-In-Time information.  The institution is the legal applicant and we rely on the Principal Investigators to assume these responsibilities.  If you are a Principal Investigator on a NIH award or proposal, please note that you are responsible for verifying the accuracy and validity of all administrative, fiscal, and programmatic Just-In-Time information at the time of submission.  PI’s are also responsible for promptly notifying NIH and the Office of Sponsored Projects Administration of any substantive changes to previously submitted Just-in-Time information up the time of award. This includes items such as Other Support changes that could lead to budgetary overlap, scientific overlap, or commitment of effort greater than 12 person-months for the PD/PI(s) or any Senior/Key Personnel; or any changes in the use or approval of vertebrate animals or human subjects.

Recent changes to the eRA Commons Just-in-Time Submission Module have improved the electronic process by allowing individual submissions of each required element separate from other elements, and by providing the new capability to submit updated information electronically as many times as necessary.

Reminder of Existing Just-in-Time Requirements:

Current Other Support:  Provide active support information for all individuals designated in an application as senior/key personnel—those devoting measurable effort to a project. Other support includes all financial resources, whether Federal, non-Federal, commercial or institutional, available in direct support of an individual’s research endeavors, including but not limited to research grants, cooperative agreements, contracts, and/or institutional awards. Training awards, prizes or gifts are not included. There is no form page for providing other support, although sample format pages are available at http://grants.nih.gov/grants/funding//phs398/othersupport.doc and http://grants.nih.gov/grants/funding/phs398/othersupport.pdf. Note that effort devoted to projects must be measured in person-months. 

Certifications:

  • IACUC Approval Date: If the proposed project involves research using live vertebrate animals, the verification date of IACUC approval along with any IACUC-imposed changes must be submitted.  Pending or out-of-date approvals are not acceptable. 
  • IRB Approval Date: If the proposed project involves human subjects research, the certification date of IRB review and approval must be submitted. Pending or out-of-date approvals are not acceptable. 
  • Human Subjects Education:  If the proposed project involves human subjects research, certification that any person identified as senior/key personnel involved in human subjects research has completed an education program in the protection of human subjects must be submitted.

Other Information Requested by the Awarding IC: NIH IC’s may also request additional Just-in-Time information on a case-by-case basis, such as revised budgets or changes to the human subjects or vertebrate animal sections of the application.

Principal Investigators are advised to submit this information only when requested by the awarding component. Non-Competing Grant Awards under the Current Continuing Resolution

The Department of Health and Human Services (HHS) continues to operate on a continuing resolution (CR) as specified in Public Law 111-242, which was signed by the President on September 30, 2010. The CR continues government operations at 2010 enacted levels through December 3, 2010.

Until the final FY 2011 appropriation is enacted, NIH will issue non-competing research grant awards at a level below that indicated on the most recent Notice of Award (generally up to 90% of the previously committed level). This is consistent with our practice during the CRs of FY 2006-2010. NIH will consider upward adjustments to these levels after the final appropriation is enacted, but expects institutions to monitor their expenditures carefully during this period.

New Procedures and Instructions for Submitting Annual Progress Reports for NIH Multi-Year Funded (MYF) Awards

Notice Number: NOT-OD-11-010

Purpose:

This notice announces new procedures and instructions for submitting annual progress reports for multi-year funded awards. Multi-year funded (MYF) awards are where the project period and budget period are the same and are longer than one year. These instructions must be followed for all MYF awards with an annual progress report due on or after 12/22/2010. For MYF awards with an annual progress report due prior to 12/22/2010, grantees should continue to follow the specific instructions of the NIH Institute or Center (IC) issuing the award.

Background

Appropriate stewardship of all NIH awards requires project performance monitoring and enforcement of terms of award. The majority of NIH awards are issued with multiple budget years within a single project period, and NIH receipt and review of the PHS 2590 Non-competing Continuation Progress Report is required in order for the grantee to receive each subsequent year of funding within the project period. A limited number of NIH awards are multi-year funded (MYF), i.e., not funded incrementally in budget years but funded in full at the start of the project period from a single fiscal year appropriation.

NIH has traditionally used multi-year funding for programs such as:

  • C06: Research Facilities Construction Grant
  • DP2: NIH Director's New Innovator Award
  • DP3: Type 1 Diabetes Targeted Research Award
  • R15: Academic Research Enhancement Award (AREA)

The American Recovery and Reinvestment Act (ARRA) provided opportunities for additional programs to use multi-year funding, for example:

  • DP4: NIH Director's Pathfinder Award
  • KM1: Institutional Career Enhancement Awards (MYF equivalent to K12)
  • RC3: Biomedical Research, Development, and Growth to Spur the Acceleration of New Technologies (BRDG-SPAN) Program

The 10/22/2010 eRA software release will implement new functionality that allows the grantee to upload a PDF progress report through the eRA Commons. Thus the procedure for submitting annual progress reports for MYF awards is being standardized across all NIH ICs for all MYF awards. This effort will enhance the NIH monitoring of MYF awards and apply a consistent process for grantee institutions.

Implementation

This new progress report submission process applies to all MYF awards with an annual progress report due on or after 12/22/2010. These instructions supersede any previous instructions regarding the timing and submission of progress reports and may represent a change from previous instructions (e.g., those contained in the Funding Opportunity Announcement) or in the terms of award as specified in the Notice of Award.

Progress Reports for MYF awards are now due annually on or before the anniversary of the budget/project period start date of the award. Effective October 22, 2010, NIH will send an automated email notification to the PD/PI two months before the anniversary of the award requesting submission of the MYF progress report. If the progress report is not submitted on or before the anniversary date of the award, an email indicating that the report is past due will be sent, and the IC will follow-up with the grantee. A progress report is not required if the award is in a no-cost extension period unless specifically required by the IC. A final progress report is always required at the end of the project period and will continue to be submitted as part of the Closeout module in the eRA Commons; the MYF feature must not be used for a final progress report.

The reporting period for a MYF progress report is the calendar year preceding the anniversary date of the award. For example, if an award is made on 04/01/2010, the MYF progress report is due on or before 04/01/2011, and should report on the activities performed under the award between 04/01/2010 and 03/31/2011. For the subsequent year the MYF progress report will be due 04/01/2012, and should report on the activities performed under the award between 04/01/2011 and 03/31/2012.

Information on the content of a MYF progress report, and instructions on how to submit the report through the eRA Commons, is posted at http://grants.nih.gov/grants/policy/myf.htm. It is important that PD/PIs follow these specific instructions when preparing a MYF progress report because certain information (e.g., on inventions) must be provided in a different location from that used in progress reports for non-MYF awards. The multi-year progress report (MYPR) link to upload the report will be available two months before the anniversary date of the award, on the eRA Commons Status search page in the folder “List of Applications/Grants” in the “Action” column. Note that the eSNAP module is not used for submission of a MYF progress report.

Progress reports for MYF awards must be completed by the PD/PI, and then submitted by a Signing Official (SO) or a PD/PI with delegated authority from the SO to submit a progress report. Information about SO delegation of authority to a PD/PI to submit a progress report appears in the eSNAP User Guide (pdf) under Section 2. Delegating Authority.

Upon submission of the report via the eRA Commons, the Program and Grants Management Officials will review the report and request any additional information or clarification if required. Unless follow-up is necessary, there will not routinely be any communication back to the grantee or PD/PI and the progress report will be considered complete and accepted.

New Time Limit for NIH Resubmission Applications

(NOT-OD-10-140)

Purpose

This notice announces the implementation of a new time limit between the submission of a New, Renewal, or Revision application and a Resubmission (A1 version) of that application to the National Institutes of Health (NIH). The time limit is intended to stimulate new research directions for projects that were not successful initially and may have become outdated over the course of several years.

Policy

The NIH will not accept a Resubmission that is submitted later than 37 months after the date of receipt ("receipt date") of the initial New, Renewal, or Revision application. Applications must be submitted for the dates listed in the appropriate Funding Opportunity Announcement (FOA) in the NIH Guide for Grants and Contracts.

Late application policies

Normal NIH late application policies (NOT-OD-08-027) will apply. If the initial submission (A0 version) was accepted late, the Resubmission (A1 version) must be received within 37 months of the original due date, not 37 months after the extended receipt date for the initial application.

Continuous submission policies

With respect to NIH continuous submission policies (NOT-OD-10-090; NOT-OD-09-155; NOT-OD-09-114; NOT-OD-08-026):

  • If an investigator was eligible for continuous submission for the first submission (A0 version) of the application and remains eligible for continuous submission for the Resubmission (A1 version), the 37 month time limit begins with the receipt date for the initial application (A0 version).
  • If an investigator submitted the first (A0) version of the application after the standard due date under the continuous submission option, but is not eligible for continuous submission for the Resubmission (A1 version), the Resubmission (A1 version) must be received by the standard due date.
  • If an investigator was not eligible for continuous submission for the first submission (A0 version) but becomes eligible after that submission, the window remains 37 months from the first submission (A0 version).

Implementation

This policy will go into effect for Resubmissions intended for the January 25, 2011, receipt date and thereafter. This policy applies to all NIH mechanisms.

NIH, AHRQ, CDC, FDA & NIOSH to Require Use of Updated Electronic Application Forms in 2011

(NOT-OD-11-007)

Purpose: The purpose of this notice is to alert applicants that NIH, AHRQ, CDC, FDA & NIOSH are transitioning to updated electronic application forms packages (ADOBE-FORMS-B1). For deadlines on or before May 7, 2011, most applicants (exceptions listed below) may use either ADOBE-FORMS-B or ADOBE-FORMS-B1 forms. For deadlines after May 7, all applicants will be required to use ADOBE-FORMS-B1 forms.

Exceptions: Applicants submitting for the following NIH programs must use ADOBE-FORMS-B1 packages for deadlines on or after January 25, 2011: Individual Research Career Development Award Programs (Ks), Institutional Training and Career Development Programs (Ts and Ds), or Individual National Research Service Awards (Fs). For more information, see Guide Notice NOT-OD-11-008.

Background: Agencies periodically implement updated versions of SF424 (R&R) grant application forms in order to remain current with the most recent form sets available through Grants.gov and approved by the Office of Management and Budget.

Beginning this month, NIH is implementing two new forms versions—Project/Performance Site Location(s) version 1.4 and R&R Other Project Information version 1.3. Please note that the incorporation of these updated forms resolves some outstanding technical and administrative issues and does not result in any major changes to the SF424 (R&R) Application Guide for NIH and other PHS agencies.

The updated forms will be incorporated into new and existing funding opportunity announcements (FOAs). The new application forms packages including these updated forms will be identified with a Competition ID of ADOBE-FORMS-B1 (the Competition ID field can be found in the application header information and when downloading the application package from Grants.gov). The specific form updates include:

  • Project/Performance Site Location(s) version 1.4
    • Update: A DUNS (Database Universal Numbering System) number is no longer required by Grants.gov for the primary performance site. Note: This field remains an NIH requirement and is enforced by NIH business rules.
  • R&R Other Project Information version 1.3
    • Update: The form has been modified to enable the Human Subject Assurance Number field whenever the answer to “Are Human Subjects Involved?” is “Yes.”

Instructions:

  • All new FOAs will be posted with ADOBE-FORMS-B1 packages.
  • In addition, ADOBE-FORMS-B1 application packages will be added to existing FOAs. Applicants may see both ADOBE-FORMS-B and ADOBE-FORMS-B1 forms packages posted to the same FOA. If presented with more than one package of forms, applicants should always download and use the most recent set of forms (forms packages are numbered sequentially) to complete their submission.
  • All applicants should carefully read their FOA and the appropriate “B Series” Application Guide for program-specific instructions before completing their application.
  • Applicants submitting for K, T, D, or F programs are exempt from this Guide Notice and should follow the specific instructions stated in NOT-OD-11-008.
  • Applicants eligible to submit under NIH’s Continuous Submission policy must use ADOBE-FORMS-B1 forms for any submissions made after May 7, 2011.
  • Learn more about choosing the correct forms packages at: http://grants.nih.gov/grants/ElectronicReceipt/files/right_forms.pdf.

Timing: To accommodate the transition to the new forms in an applicant-friendly manner, NIH, AHRQ, CDC, FDA and NIOSH will accept applications submitted using either ADOBE-FORMS-B or ADOBE-FORMS-B1 forms for deadlines on or before May 7, 2011. For deadlines after May 7, 2011, all applicants will be required to submit grant applications using only ADOBE-FORMS-B1 forms. Submissions using the ADOBE-FORMS-B application forms after May 7, 2011, will not be accepted.

Updated Electronic Application Forms Required for F, K, T & D Submissions with Due Dates of January 25, 2011 and Beyond

(NOT-OD-11-008)

Purpose:
This notice announces that applicants targeting due dates on or after January 25, 2011 MUST download and use a new version of the SF424 (R&R) application packages for the following programs:

  • Individual National Research Service Awards (Fs)
  • Individual Research Career Development Award Programs (Ks)
  • Institutional Training and Career Development  Programs (Ts) and Other Training Grants (Ds)

The current SF424 (R&R) Application Guides will be expanded to included special instructions for applicants using the new forms to apply for awards under F, K, T and D activity codes.

Background:
The new forms packages will resolve the issues detailed in NOT-OD-10-052, in which the current application forms were in some cases limiting the ability of applicants to supply all required information for resubmission applications that were also renewals or revisions.  

The new application packages also include the following updates:

  • For Fellowship (F) applications, the “PHS Fellowship Supplemental” form has a new “Sponsor(s) and Co-Sponsor(s)” attachment which will be used to collect information that was previously documented in the “Other Attachment” section of the R&R “Other Project Information” form.
  • Existing program-specific page limits for Career Development (K) submissions will now be electronically enforced.  K applications that exceed the page limits will receive eRA Commons errors which must be corrected before the submission deadline.
  • The R&R “Other Project Information” form has been updated to enable the Human Subject Assurance Number field whenever the answer to “Are Human Subjects Involved?” is “Yes”.

Instructions:

  • All F, K, T and D submissions on or after January 25, 2011 must use the new application forms. Applications submitted using incorrect application forms will not be accepted.

    NOTE:  The new SF424 (R&R) form will be identified by a competition ID of “ADOBE-FORMS-B1”. The competition ID field is visible in the application header information and when downloading the application package from Grants.gov. Learn more about how to choose the correct forms package for your application. 

  • NOT-OD-10-052 provided applicants with special interim instructions for submitting revision or renewal applications that are also resubmissions. Once the new forms are introduced, these instructions will no longer be valid. Applicants should carefully read their Funding Opportunity Announcement (FOA) and the appropriate updated “B Series” Application Guide for program specific instructions before completing their application.

Timing:

  • The new “ADOBE-FORMS-B1” packages will be released by grant type at least four weeks prior to the first round of submission deadlines falling on or after January 25, 2011. Applicants must return to the FOA or reissued parent announcement to download the new application forms once they are available. If both the “Adobe B” and the “Adobe B1” forms packages are available, applicants should download and use the B1 forms. 
  • The updated and expanded B Series Application Guide will be available in December 2010.

NOTE: The information and instructions in this guide notice applies to submissions for the F, K, T and D activity codes only. All other applicants should refer to NOT-OD-11-007 for information concerning the transition to ADOBE-FORMS-B1.

Center for Clinical and Translational Science Pilot Research Program

The Center for Clinical and Translational Science Pilot Research Program is calling for applications. For more information on this program, click here for the Word doc. Click here for the application in Word.

The next round of applications will be due November 15, 2010. In order to qualify for this round of funding the CCTS must receive a Letter of Intent (LOI) and an attached investigator biosketch (NIH format) prior to October 15, 2010. The LOI should include a description of the research project (200 words), a statement of how the pilot grant would facilitate a future external grant and include the following information:

  • Principal Investigator
    • Full name, degree(s), title(s)
    • Office address, phone, fax, email address
  • Names of other key personnel
    • Name, phone, email address of the Mentor
    • Name, phone, email address of 2 or 3 UK or external reviewers
