NCURA Satellite Conference
Contracting with Industry: Divergent Views and Issues

The program will highlight divergent views and issues associated with industrial contracting. Perspectives of the university administrator, the university attorney and the company sponsor will be incorporated as we focus on cultural differences. Robert Killoren and his faculty will examine some of the "hot-button" issues that plague university-industry contract negotiations: restrictions on publication, intellectual-property rights, and full reimbursement of indirect costs. Mutually acceptable, ethical, and honorable solutions for these issues will be discussed.

Human Subjects Protection Education Requirements

In February 2001, the Department of Health and Human Services announced that its "responsible conduct in research" training requirements had been suspended pending congressional investigation. This suspension does not apply to the requirements for human subjects protection education. In fact, the mandatory requirements for human subjects protection education have been recently expanded.

In December 2000, the Office of Human Research Protection (OHRP), which regulates research at the University of Kentucky, established new, mandatory human research protection education requirements. With the revision of the federal-wide assurance program, requirements for human subjects protection education have been extended to:

  • Institutional Review Board Members
  • Institutional Review Board Administrators
  • The Designated Institutional Official
  • Research Investigators and Research Staff Covered by the Assurance

Currently, key personnel on National Institutes of Health-funded projects, and individuals conducting human subjects research in the Veterans Affairs Medical Center are required to complete the University of Kentucky mandatory Institutional Review Board (IRB) education program.

The new requirements will be phased in at UK over the next year. First, University of Kentucky Institutional Review Board members and Office of Research Integrity (ORI) staff will complete the training. Next, key personnel in all federally funded projects at UK will be asked to complete a human subjects education program. Decisions about the content of the program have not been made. The University hopes to implement these programs by Oct. 1, 2001. Eventually, the requirements will be extended to all key personnel conducting human subjects research, regardless of the funding source. Decisions regarding continuing education requirements have not yet been made.
